{"id":10784,"date":"2016-12-08T15:16:40","date_gmt":"2016-12-08T15:16:40","guid":{"rendered":"http:\/\/unitelive.org\/?p=10784"},"modified":"2016-12-08T15:16:40","modified_gmt":"2016-12-08T15:16:40","slug":"legal-action-threat","status":"publish","type":"post","link":"https:\/\/unitelive.test.igniteamt.com\/?p=10784","title":{"rendered":"Legal action threat"},"content":{"rendered":"<div id=\"fb-root\"><\/div>\n<p>Unite has threatened to take legal action after staff working on Glasgow\u00e2\u20ac\u2122s new waste power plant were locked out of the the site and paid off with just a week\u00e2\u20ac\u2122s notice.<\/p>\n<p>&nbsp;<\/p>\n<p>Glasgow City Council contracted with Viridor to build the Recycling and Renewable Energy Centre in Polmadie. Viridor then sub-contracted some of the construction work to another company Interserve.<\/p>\n<p>&nbsp;<\/p>\n<p>But last month, Viridor announced that it was going to take Interserve off the contract \u00e2\u20ac\u201c and now Interserve has told workers that they are going to be let go. Viridor has still not announced who their new preferred contractor will be.<\/p>\n<p>&nbsp;<\/p>\n<p>Unite says that the workers are protected by Transfer of Undertakings Protection of Employment Regulations (TUPE) \u00e2\u20ac\u201c and any attempt to lay them off will be grounds for possible legal action and compensation claims.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bViridor is getting paid out of public money,&#8221; said Unite Scottish secretary Pat Rafferty. &#8220;It is their inaction that has put our members in this situation. That is completely unacceptable.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bAs far as we\u00e2\u20ac\u2122re concerned, our members are protected by TUPE regulations. Any employer trying to breach our members\u00e2\u20ac\u2122 rights will leave themselves open to possible legal action.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bWe urge Viridor to urgently act to sort this situation out and we are calling on Glasgow City Council to help,&#8221; he added. &#8220;We are consulting with our lawyers and will do everything in our power to ensure that our members on this publicly-funded project are treated with dignity and respect \u00e2\u20ac\u201c and that their legal rights are respected.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bWe won\u00e2\u20ac\u2122t accept our members being left with this uncertainty \u00e2\u20ac\u201c especially at this time of year.\u00e2\u20ac\u0165<\/p>\n<p>&nbsp;<\/p>\n<p>Unite understands that around 100 scaffolders have been told by Interserve that they will be kept on for 20 days.
