{"id":11777,"date":"2017-03-14T12:38:40","date_gmt":"2017-03-14T12:38:40","guid":{"rendered":"http:\/\/unitelive.org\/?p=11777"},"modified":"2017-03-14T15:35:41","modified_gmt":"2017-03-14T15:35:41","slug":"tipping-the-balance-2","status":"publish","type":"post","link":"https:\/\/unitelive.test.igniteamt.com\/?p=11777","title":{"rendered":"Tipping the balance"},"content":{"rendered":"<div id=\"fb-root\"><\/div>\n<p>As the government drags its feet over the publication of its consultation on tipping practices \u00e2\u20ac\u201c now a full eight months overdue \u00e2\u20ac\u201c restaurants continue to get away with brazen theft of staff tips.<\/p>\n<p>&nbsp;<\/p>\n<p>The latest among these is the Ivy Collection, a group of restaurants inspired by the iconic celebrity haunt the Ivy, where dinner for two runs into the hundreds of pounds.<\/p>\n<p>&nbsp;<\/p>\n<p>The restaurant group levies a 12.5 per cent service charge on all bills \u00e2\u20ac\u201c but staff say that they hardly receive any of it, <a href=\"https:\/\/www.theguardian.com\/money\/2017\/mar\/12\/ivy-collection-restaurant-group-service-charge-unite-union\">according to a Guardian investigation.<\/a><\/p>\n<p>&nbsp;<\/p>\n<p>Waiters and chefs largely earn only the minimum wage, now set at \u00c2\u01417.20 an hour. They get an additional \u00c2\u01411.30 an hour \u00e2\u20ac\u015bcommission\u00e2\u20ac\u0165 but this so-called commission doesn\u00e2\u20ac\u2122t ever vary based on how much service charge the restaurant brings in.<\/p>\n<p>&nbsp;<\/p>\n<p>Others such as runners who pick up dishes get only 80p an hour in \u00e2\u20ac\u015bcommission\u00e2\u20ac\u0165 and some get nothing at all, staff say.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bI put through more than \u00c2\u01411,500 [in diners\u00e2\u20ac\u2122 bills] on a shift and when you see only about \u00c2\u01417 of that on top of the minimum wage you can see they are very tight with money,\u00e2\u20ac\u0165 one former waiter told the Guardian.<\/p>\n<p>&nbsp;<\/p>\n<p>A member of kitchen staff said he felt helpless about the situation.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bBusiness is good, business is bad, our commission stays the same,\u00e2\u20ac\u0165 he said. \u00e2\u20ac\u015bNobody feels they can do or say anything about it or we will lose our jobs.\u00e2\u20ac\u0165<\/p>\n<p>&nbsp;<\/p>\n<p>The Ivy Collection denied that it withholds service charges from staff.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bAll restaurant based staff at the Ivy Collection are paid, at the very least, the minimum wage and this wage is then significantly increased with money from the service charge, minus the relevant taxes imposed by HM Revenue and Customs,\u00e2\u20ac\u0165 a spokesperson from the restaurant said.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bThe vast majority of the money from the service charge is given to the restaurant staff, not the management.\u00e2\u20ac\u0165<\/p>\n<p>&nbsp;<\/p>\n<p>But Unite regional officer David Turnbull said that by just looking at the accounts of, for example, the Chelsea Grill, one of the group\u00e2\u20ac\u2122s restaurants, this couldn\u00e2\u20ac\u2122t possibly be true.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><em>\u00e2\u20ac\u0098Commission\u00e2\u20ac\u2122<\/em><\/strong><\/p>\n<p>Unite has found that the Chelsea Grill took about \u00c2\u01411m in service charges, and total staff wages, including the so-called \u00e2\u20ac\u0098commission\u00e2\u20ac\u2122 added up to \u00c2\u01412.6m.<\/p>\n<p>&nbsp;<\/p>\n<p>Even if all 184 of the Grill\u00e2\u20ac\u2122s workers, excluding two directors, worked the entire year full-time, for 45 hours each week, and everyone got the same \u00c2\u01411.30 an hour in commission, the numbers simply wouldn\u00e2\u20ac\u2122t add up \u00e2\u20ac\u201c the total paid out in commission would come to \u00c2\u0141600,000, meaning a \u00c2\u0141400,000 deficit.<\/p>\n<p>&nbsp;<\/p>\n<p>This, Turnbull said, raised questions over whether the service charge was being used to top up senior management\u00e2\u20ac\u2122s wages.<\/p>\n<p>&nbsp;<\/p>\n<p>The Ivy Collection isn\u00e2\u20ac\u2122t the only culprit in the hospitality industry in recent months blamed for service charge theft either.<\/p>\n<p>&nbsp;<\/p>\n<p>Late last year, former Masterchef judge Michel Roux, owner of the Michelin-starred Le Gavroche, <a href=\"https:\/\/www.theguardian.com\/lifeandstyle\/2016\/dec\/15\/michel-roux-jr-restaurant-staff-no-share-service-charge-le-gavroche\">admitted<\/a> that service charge at his restaurant \u00e2\u20ac\u201c where dinner for two on the fixed price menu totals \u00c2\u0141212 \u00e2\u20ac\u201c is treated as revenue and isn\u00e2\u20ac\u2122t distributed to staff.<\/p>\n<p>&nbsp;<\/p>\n<p>This was after <a href=\"https:\/\/www.theguardian.com\/lifeandstyle\/2016\/nov\/18\/michel-roux-jr-chefs-minimum-wage-le-gavroche\">another Guardian investigation<\/a> found that staff at Le Gavroche weren\u00e2\u20ac\u2122t being paid the legal minimum wage.<\/p>\n<p>&nbsp;<\/p>\n<p>At the time, a La Gavroche spokesperson asserted that the service charge did indeed go to staff, noting, \u00e2\u20ac\u015bAll Le Gavroche staff, front of house and kitchen, share in the 13 per cent discretionary service charge.\u00e2\u20ac\u0165<\/p>\n<p>&nbsp;<\/p>\n<p>Roux has since announced that the restaurant would be dropping the service charge entirely.<\/p>\n<p>&nbsp;<\/p>\n<p>Unite has also <a href=\"http:\/\/unitelive.org\/decent-work-call\/\">recently targeted Malmaison hotels<\/a> in London and Leeds, after the union\u00e2\u20ac\u2122s conversations with staff there revealed that management had been using service charges to cover breakages and to top up tills that were short on cash.<\/p>\n<p>&nbsp;<\/p>\n<p>Unite orchestrated a day of protest outside Malmaison hotels last month, which called on the chain to reverse its service charge policy and tackle other workplace issues staff had brought up such as bullying.<\/p>\n<p>&nbsp;<\/p>\n<p>While Unite has long campaigned to end unfair tipping practices by targeting individual restaurants \u00e2\u20ac\u201c the union\u00e2\u20ac\u2122s <a href=\"http:\/\/unitelive.org\/tag\/pizza-express\/\">Pizza Express campaign<\/a> has been the most notable example, prompting several restaurants to change their tipping policies \u00e2\u20ac\u201c it also continues to lobby for a change in the law.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bMost people pay the service charge without question believing that the extra cash goes entirely to the staff that served them.
