{"id":12673,"date":"2017-06-23T14:18:52","date_gmt":"2017-06-23T13:18:52","guid":{"rendered":"http:\/\/unitelive.org\/?p=12673"},"modified":"2017-06-27T17:13:00","modified_gmt":"2017-06-27T16:13:00","slug":"cruel-cap-ruled-unlawful","status":"publish","type":"post","link":"https:\/\/unitelive.test.igniteamt.com\/?p=12673","title":{"rendered":"Cruel cap ruled unlawful"},"content":{"rendered":"<div id=\"fb-root\"><\/div>\n<p>In a damning judgement the Tories\u00e2\u20ac\u2122 cruel benefit cap has been ruled unlawful by the High Court because it discriminates against single parent families with children under two.<\/p>\n<p>&nbsp;<\/p>\n<p>Delivering the verdict, High Court judge Mr Justice Collins said, \u00e2\u20ac\u015bReal misery is being caused to no good purpose.\u00e2\u20ac\u0165<\/p>\n<p>&nbsp;<\/p>\n<p>The massive defeat for the government means that ministers will likely be forced amend or scrap a central plank of their <a href=\"http:\/\/unitelive.org\/tag\/benefits\/\">welfare<\/a> policies.<\/p>\n<p>&nbsp;<\/p>\n<p>Unite welcomed the ruling against the cap, which sets a ceiling of \u00c2\u014123,000 in London and \u00c2\u014120,000 elsewhere for the total amount of benefits a household can receive, and said increasing council <a href=\"http:\/\/unitelive.org\/tag\/housing\/\">housing<\/a> stock is the only way to lower the exorbitant housing benefit costs the cap is linked to.<\/p>\n<p>&nbsp;<\/p>\n<p>The case was brought before the High Court by four single parent families \u00e2\u20ac\u201c two of which had been made homeless because of domestic violence \u00e2\u20ac\u201c who were severely and disproportionately impacted by the cap.<\/p>\n<p>&nbsp;<\/p>\n<p>The families\u00e2\u20ac\u2122 solicitor said their benefits were due to be cut because the parents could not work the 16 hours a week needed to avoid the cap.<\/p>\n<p>&nbsp;<\/p>\n<p>Ministers tried to have the case thrown out but their motion was rejected by the court, which ruled at beginning of the year for the case to be heard as a priority.<\/p>\n<p>&nbsp;<\/p>\n<p>The government said it was \u00e2\u20ac\u015bdisappointed\u00e2\u20ac\u0165 by the court\u00e2\u20ac\u2122s ruling and will appeal the decision. The cap will remain in place during the appeal process.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><em>\u00e2\u20ac\u0098Poorest families\u00e2\u20ac\u2122<\/em><\/strong><\/p>\n<p>Delivering the verdict, Justice Collins said, \u00e2\u20ac\u015bThose in need of welfare benefits fall within the poorest families with children. It seems that some 3.7m children live in <a href=\"http:\/\/unitelive.org\/tag\/poverty\/\">poverty<\/a> and, as must be obvious, the cap cannot but exacerbate this.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bThe need for alternative benefits to make up shortfalls is hardly conducive to the desire to incentivise work and so not provide benefits. There is powerful evidence that very young children are particularly sensitive to environmental influences. Poverty can have a very damaging effect on children under the age of five.\u00e2\u20ac\u0165<\/p>\n<p>&nbsp;<\/p>\n<p>He added, \u00e2\u20ac\u015bThe cap is capable of real damage to such as the claimants. They are not workshy but find it, because of the care difficulties, impossible to comply with the work requirement. Most lone parents with children under two are not the sort of households the cap was intended to cover&#8230; Real misery is being caused to no good purpose.\u00e2\u20ac\u0165<\/p>\n<p>&nbsp;<\/p>\n<p>Head of Unite Community, Liane Groves, called on the government \u00e2\u20ac\u015bnot to waste taxpayers money\u00e2\u20ac\u0165 trying to appeal the decision. She said ministers should abandon the cap completely, which she said was driving families out of their homes and away from their support networks.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><em>\u00e2\u20ac\u0098Incredibly cruel\u00e2\u20ac\u2122 <\/em><\/strong><\/p>\n<p>\u00e2\u20ac\u015bThis is an incredibly cruel policy that affects not just London but vast swathes of the South East and parts of every major city. It is tied to a lack of affordable housing,\u00e2\u20ac\u0165 Groves said.<\/p>\n<p>&nbsp;<\/p>\n<p>Unite assistant general secretary Steve\u00c2\u00a0Turner\u00c2\u00a0said the answer to housing crisis in London and the rest of the UK was simple \u00e2\u20ac\u201c build more council housing and implement rent controls.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bMore and more people simply aren\u00e2\u20ac\u2122t able to afford the most basic necessity that is housing.\u00c2\u00a0And it\u00e2\u20ac\u2122s getting worse each and every year as this government \u00e2\u20ac\u201c which does not have the words \u00e2\u20ac\u0098long-term thinking\u00e2\u20ac\u2122 in its vocabulary \u00e2\u20ac\u201c sits back and allows it all to happen,\u00e2\u20ac\u0165 Turner said.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bBut it doesn\u00e2\u20ac\u2122t have to be this way.\u00c2\u00a0We\u00c2\u00a0can\u00c2\u00a0build the million new council homes this country needs. We\u00c2\u00a0can\u00c2\u00a0introduce rent controls that protect those in what is now the least regulated private rental market in all of Europe.
