{"id":14071,"date":"2017-12-05T15:09:42","date_gmt":"2017-12-05T15:09:42","guid":{"rendered":"http:\/\/unitelive.org\/?p=14071"},"modified":"2017-12-05T15:09:42","modified_gmt":"2017-12-05T15:09:42","slug":"legal-knockout-blow","status":"publish","type":"post","link":"https:\/\/unitelive.test.igniteamt.com\/?p=14071","title":{"rendered":"Legal &#8216;knockout&#8217; blow"},"content":{"rendered":"<div id=\"fb-root\"><\/div>\n<p>A bogus self-employment case supported by Unite, which could set a legally binding precedent for tribunals across the UK, gets underway today (December 5) at the employment appeal tribunal in London.<\/p>\n<p>&nbsp;<\/p>\n<p>The case against the recruitment agency On-Site Recruitment Solutions Limited for the unlawful deduction of wages, employer\u00e2\u20ac\u2122s national insurance and non-payment of holiday pay will be the first time an employment appeal tribunal has considered a bogus self-employment appeal involving the use of a payroll company.<\/p>\n<p>&nbsp;<\/p>\n<p>Brought by pipefitter Russ Blakely, with the support of Unite\u00e2\u20ac\u2122 strategic case unit, the case could deal a major legal blow to employers and employment agencies using \u00e2\u20ac\u0098umbrella\u00e2\u20ac\u2122 companies and \u00e2\u20ac\u0098sham\u00e2\u20ac\u2122 payroll firms to cheat workers out of their rights and hard earned wages.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bThe importance of today\u00e2\u20ac\u2122s hearing cannot be underestimated,&#8221; said Unite assistant general secretary for legal services Howard Beckett. &#8220;This is the first time that the appeal courts have considered a case involving bogus self-employment and the use of a \u00e2\u20ac\u0098sham\u00e2\u20ac\u2122 payroll company to strip workers of their rights.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bWe are increasingly seeing agencies and employers adopting these fictitious models in an underhand attempt to avoid their responsibilities and charge employer\u00e2\u20ac\u2122s tax and national insurance liabilities to workers undertaking insecure and often temporary work.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bThis is precisely the type of sham arrangement that denies people of their rights at work and robs them of their holiday pay that Unite\u00e2\u20ac\u2122s strategic case unit has been set up to tackle,&#8221; he added.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bThe employment appeal tribunal\u00e2\u20ac\u2122s decision will set an eagerly awaited binding legal precedent that tribunals across the country will be required to follow. If successful, we expect it to send shockwaves through the construction industry and other sectors that adopt exploitative payroll and \u00e2\u20ac\u0098umbrella\u00e2\u20ac\u2122 company models.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bThis is also the first bogus self-employment case to be considered by the appeal court since the European Court of Justice\u00e2\u20ac\u2122s decision last week in King v Sash Windows confirmed that employers\u00e2\u20ac\u2122 cannot escape paying workers\u00e2\u20ac\u2122 holiday pay by using sham self-employed arrangements,&#8221; Beckett went on to say.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bBad employers should beware that Unite members have the unwavering support of the UK\u00e2\u20ac\u2122s largest trade union.\u00e2\u20ac\u0165<\/p>\n<p>&nbsp;<\/p>\n<p>From January 19, 2016 until May 20, 2016 Mr Blakely was employed on the NHS funded Broadmoor hospital redevelopment project in Berkshire by On-Site. Confirming he was to undertake work on the project On-Site texted Mr Blakely and informed him that he needed to contact an umbrella\/payroll company, Heritage Solutions City Limited for payment.<\/p>\n<p>&nbsp;<\/p>\n<p>Mr Blakely was paid weekly and was deducted a weekly fee of \u00c2\u014118 by Heritage from his pay (described as management company margin). He was also charged the employer\u00e2\u20ac\u2122s national insurance contributions, labelled on his payslip as \u00e2\u20ac\u0098HMRC Payment NIERS\u00e2\u20ac\u2122. In total he was charged \u00c2\u0141324 in management fees and \u00c2\u0141725.59 in employer NICs.<\/p>\n<p>&nbsp;<\/p>\n<p>In March 2016, Heritage Solutions asked Mr Blakely to sign \u00e2\u20ac\u0098a contract for services\u00e2\u20ac\u2122 seeking to deny him the most basic worker rights, including auto-enrolment pension, holiday pay and sick pay.<\/p>\n<p>&nbsp;<\/p>\n<p>The contract also attempted to authorise deductions for employer\u00e2\u20ac\u2122s class 1 national insurance from Mr Blakely\u00e2\u20ac\u2122 pay and included a menacing \u00e2\u20ac\u0098indemnity\u00e2\u20ac\u2122 clause aimed at stopping him from pursuing any legal claims and gagging him from raising complaints with HMRC. He was told that if he did not sign the agreement his pay would be stopped. Despite this, Mr Blakely refused to sign.<\/p>\n<p>&nbsp;<\/p>\n<p>He continued to work until May 20, 2016, when he took holiday and was told that he was not needed to return.<\/p>\n<p>&nbsp;<\/p>\n<p>The case was initially heard at the Reading employment tribunal which dismissed the claim believing he was not a worker having failed to properly understand the evidence provided.
