{"id":14905,"date":"2018-03-29T14:35:41","date_gmt":"2018-03-29T13:35:41","guid":{"rendered":"http:\/\/unitelive.org\/?p=14905"},"modified":"2020-11-12T12:59:05","modified_gmt":"2020-11-12T12:59:05","slug":"clawback-address-unfairness-call","status":"publish","type":"post","link":"https:\/\/unitelive.test.igniteamt.com\/?p=14905","title":{"rendered":"\u00e2\u20ac\u0098Address this unfairness\u00e2\u20ac\u2122 call"},"content":{"rendered":"<div id=\"fb-root\"><\/div>\n<p>Sharon McGeough-Adams worked for nearly four decades at HSBC and hardly had a day off.<\/p>\n<p>&nbsp;<\/p>\n<p>Despite having to live with Crohn\u00e2\u20ac\u2122s disease when she left the bank in 2012, she looked forward to a modest retirement that would enable her to make ends meet and allow her to spend quality time with her loved ones.<\/p>\n<p>&nbsp;<\/p>\n<p>Then she discovered what thousands of others who worked for what was previously called Midland Bank are now just starting to find out \u00e2\u20ac\u201c that once they reach State Pension Age, they stand to lose in some cases up to a third of their pension each year.<\/p>\n<p>&nbsp;<\/p>\n<p>Hidden in the small print of their pensions is what HSBC has called \u00e2\u20ac\u0098state deduction\u00e2\u20ac\u2122 \u00e2\u20ac\u201c a confusing term that these thousands of workers assumed was an amount taken by the government.<\/p>\n<p>&nbsp;<\/p>\n<p>But after chatter on a Facebook page which would soon transform into a campaigning tool, these past and current workers were led to a startling discovery.<\/p>\n<p>&nbsp;<\/p>\n<p>This \u00e2\u20ac\u0098state deduction\u00e2\u20ac\u2122 had nothing to do with the government. It was money HSBC was surreptitiously stripping out of their retirement incomes that they had worked for decades to earn.<\/p>\n<p>&nbsp;<\/p>\n<p>Sharon, who is now 60, will be stripped of \u00c2\u01412,317 each year once she turns the state pension age of 66 in five years\u00e2\u20ac\u2122 time \u00e2\u20ac\u201c that\u00e2\u20ac\u2122s around \u00c2\u0141200 each month.<\/p>\n<p>&nbsp;<\/p>\n<p>It\u00e2\u20ac\u2122s a practice called \u00e2\u20ac\u0098clawback\u00e2\u20ac\u2122 where employers reduce, or \u00e2\u20ac\u0098claw back\u00e2\u20ac\u2122 their former workers\u00e2\u20ac\u2122 pensions by the basic state pension amount once they reach state pension age.<\/p>\n<p>&nbsp;<\/p>\n<p>Some are even worse off than Sharon &#8212; the amount deducted through clawback varies widely among different pension scheme members depending on how long they\u00e2\u20ac\u2122ve worked and when they started.<\/p>\n<p>&nbsp;<\/p>\n<p>Those who don\u00e2\u20ac\u2122t receive the full basic state pension will, under HSBC\u00e2\u20ac\u2122s clawback policy, still have the full amount deducted. Clawback also disproportionately affects those on the lower end of the income scale.<\/p>\n<p>&nbsp;<\/p>\n<h2><\/h2>\n<h2><strong><em>\u00e2\u20ac\u0098Grossly unfair\u00e2\u20ac\u2122 <\/em><\/strong><\/h2>\n<p>\u00e2\u20ac\u015bYou can have a clerical staff member who retires on a pension income of just over \u00c2\u01414,500 a year who\u00e2\u20ac\u2122ll take a hit of about \u00c2\u01411,500 a year through clawback, which is more than a third of their income,\u00e2\u20ac\u0165 Sharon explained. \u00e2\u20ac\u015bBut then at the same time you\u00e2\u20ac\u2122ll have someone retiring on an income of \u00c2\u014150,000 a year, and they\u00e2\u20ac\u2122re hit by the same exact deduction, which amounts to only 3 per cent of their retirement income. It\u00e2\u20ac\u2122s grossly unfair.\u00e2\u20ac\u0165<\/p>\n<p>&nbsp;<\/p>\n<p>HSBC operates more than 20 pension schemes and only members of one \u00e2\u20ac\u201c those who are on the post-1974 Midland Bank defined benefit pension scheme, about 50,000 people \u00e2\u20ac\u201c are subject to clawback.<\/p>\n<p>&nbsp;<\/p>\n<p>And in 21st century Britain, HSBC is now in the minority of companies still applying clawback. About 70 per cent of private pension schemes that previously used clawback have phased it out \u00e2\u20ac\u201c and the public sector did away with the practice entirely nearly 40 years ago.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bMany first discovered clawback when it was being discussed on a Facebook page for former Midland Bank workers. We feel that \u00e2\u20ac\u0098state deduction\u00e2\u20ac\u2122 was never explained fully and certainly not at the induction when it should have been made clear,\u00e2\u20ac\u0165 Sharon told UNITElive.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bOnce clawback became a major topic of discussion on Facebook, we decided to start a separate Facebook page dedicated solely to the issue of clawback and how we can fight back.\u00e2\u20ac\u0165<\/p>\n<p>&nbsp;<\/p>\n<p>Over only a two-year period, the Facebook page has garnered more than 9,000 members. The Midland Clawback Campaign also has a Twitter account and a website where people affected by clawback can share their stories and fill out a survey.<\/p>\n<p>&nbsp;<\/p>\n<p>And the group\u00e2\u20ac\u2122s activism has transcended the online realm too \u00e2\u20ac\u201c they\u00e2\u20ac\u2122ve formed a committee that has lobbied Parliament and received the support of MPs across the political spectrum.<\/p>\n<p>&nbsp;<\/p>\n<p>They\u00e2\u20ac\u2122ve written to HSBC bosses who, though remaining unmoved by their arguments, have implicitly acknowledged that their communication wasn\u00e2\u20ac\u2122t always the best \u00e2\u20ac\u201c after a meeting late last year, the specific wording in official communications to members was changed overnight.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bThe whole time they\u00e2\u20ac\u2122ve said in their communications that DBS pension scheme members would receive a pension of \u00e2\u20ac\u0098up to two-thirds final salary\u00c2\u00a0<em>and<\/em>\u00c2\u00a0a basic state pension\u00e2\u20ac\u2122,\u00e2\u20ac\u0165 Sharon explained. \u00e2\u20ac\u015bAfter that meeting, when the campaign against clawback was on the agenda, they changed this wording to \u00e2\u20ac\u0098two-thirds final salary\u00c2\u00a0<em>including<\/em>\u00c2\u00a0state pension\u00e2\u20ac\u2122. They\u00e2\u20ac\u2122re just 42 years too late.\u00e2\u20ac\u0165<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<h2><strong><em>Ramp up fight<\/em><\/strong><\/h2>\n<p>Now, the campaigners have teamed up with Unite to further ramp up their fight.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bWe\u00e2\u20ac\u2122ve had a few meetings with Unite and they\u00e2\u20ac\u2122ve given us the guidance and tools to take our campaign forward,\u00e2\u20ac\u0165 Sharon said. \u00e2\u20ac\u015bWe\u00e2\u20ac\u2122ve had legal advice from them and they\u00e2\u20ac\u2122re also helping us to negotiate with the bank a way forward without clawback.\u00e2\u20ac\u0165<\/p>\n<p>&nbsp;<\/p>\n<p>The Midland Clawback Campaign has argued that removing clawback is a perfectly reasonable demand \u00e2\u20ac\u201c aside from the rank injustice suffered by the bank\u00e2\u20ac\u2122s lowest paid workers, the cost to end this injustice is \u00c2\u0141442m.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bThe bank itself has said this sum is do-able \u00e2\u20ac\u201c against a backdrop of HSBC\u00e2\u20ac\u2122s pre-tax profits last year of \u00c2\u014112.3bn, it\u00e2\u20ac\u2122s easy to see why,\u00e2\u20ac\u0165 Sharon notes.<\/p>\n<p>&nbsp;<\/p>\n<p>Ultimately, the campaigners are fighting not just for their individual pensions but to put an end to one aspect of growing inequality that has come to define the finance sector.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bClawback is inherently discriminatory because it hits the lowest-paid \u00e2\u20ac\u201c most of whom are women \u00e2\u20ac\u201c hardest. It is galling when you read that [former HSBC CEO] Stuart Gulliver will get paid millions even after leaving the bank this year and then you have tens of thousands of low-paid workers facing an uncertain future in retirement.<\/p>\n<p>&nbsp;<\/p>\n<h2><\/h2>\n<h2><strong><em>\u00e2\u20ac\u0098It\u00e2\u20ac\u2122s got to stop\u00e2\u20ac\u2122<\/em><\/strong><\/h2>\n<p>\u00e2\u20ac\u015bSomething has gone terribly wrong when you speak to a woman affected by clawback whose husband has cancer and is struggling to survive financially. It\u00e2\u20ac\u2122s an even bigger slap in the face when this woman tells the bank her story and they simply refer her to a charity. This has got to stop.\u00e2\u20ac\u0165<\/p>\n<p>&nbsp;<\/p>\n<p>Unite national officer for finance Dominic Hook praised the campaign and explained why Unite is lending its full support.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bThe post-1974 pension scheme was arguably designed when people worked full time and for their entire careers for the same employer,\u00e2\u20ac\u0165 he said. \u00e2\u20ac\u015bThe present reality has been very different &#8212; we have a wide range of low-paid and part-time staff who are coming up to retirement and where the state deduction has a disproportionate effect on them compared to their more highly paid colleagues.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bWhat\u00e2\u20ac\u2122s more, the pension fund was in surplus at the last valuation at a time when so many pension funds are in deficit.
