490 days and counting \u00e2\u20ac\u201c that\u00e2\u20ac\u2122s how long Australian offshore worker and AMWU union rep Troy Carter and his colleagues have been off work in a dispute with their employer.<\/p>\n

 <\/p>\n

Their fight\u00e2\u20ac\u2122s astonishing length, now well into its second year, isn\u00e2\u20ac\u2122t the only thing that\u00e2\u20ac\u2122s made this industrial dispute remarkable. These maintenance workers aren\u00e2\u20ac\u2122t, after all, taking on any old boss; they\u00e2\u20ac\u2122re taking on ExxonMobil — one of the biggest players in the one of the most lucrative industries in history.<\/p>\n

 <\/p>\n

‘Take it or leave it’<\/strong><\/em><\/p>\n

It all started in June last year, when ExxonMobil\u00e2\u20ac\u2122s Australian affiliate Esso granted a new maintenance contract to contractor UGL after the previous 7-year contract had come to an end. Before, UGL and another firm held the contract jointly. Once UGL won it outright in 2017, 230 maintenance workers were immediately sacked — and then offered their jobs back at massively reduced pay and terms and conditions.<\/p>\n

 <\/p>\n

\u00e2\u20ac\u015bUGL had slashed our pay by 40 per cent,\u00e2\u20ac\u0165 he said. \u00e2\u20ac\u015bBefore we were on family-friendly seven-days-off and seven-days-on rotas. In the new contract, the wording stated that we would \u00e2\u20ac\u0098work at the discretion of the company\u00e2\u20ac\u2122 so in practice we could work 52 weeks throughout the year, with no clauses on equal time off.<\/p>\n

 <\/p>\n

\u00e2\u20ac\u015bThey also put in a \u00e2\u20ac\u0098stand down\u00e2\u20ac\u2122 clause, which means if for example equipment broke while we were at work, we\u00e2\u20ac\u2122d have to \u00e2\u20ac\u0098stand down\u00e2\u20ac\u2122 and be stuck on an oil rig indefinitely away from our families — without pay — until the issue was resolved.\u00e2\u20ac\u0165<\/p>\n

 <\/p>\n

UGL scrapped all full-time work so that workers would from then on be on casual contracts; allowances were cut as were annual leave entitlements. Health and safety protections were likewise watered down.<\/p>\n

 <\/p>\n

\u00e2\u20ac\u015bEssentially they undercut everything we\u00e2\u20ac\u2122d worked so hard as a union and a workforce to negotiate over the years,\u00e2\u20ac\u0165 Troy (pictured below) explained.<\/p>\n

\"troy<\/p>\n

UGL\u00e2\u20ac\u2122s harsh \u00e2\u20ac\u0098take it or leave it\u00e2\u20ac\u2122 contract may seem to us so unjust as to be illegal \u00e2\u20ac\u201c after all, if the same company took over the new contract, wouldn\u00e2\u20ac\u2122t the collective agreement in place before still apply?<\/p>\n

 <\/p>\n

Sham agreements<\/strong><\/em><\/p>\n

But just like in the UK, rogue businesses in Australia attempt to exploit every loophole in employment regulations that they can get away with. In the case of UGL, they deliberately stalled on collective agreement negotiations until the agreement expired.<\/p>\n

 <\/p>\n

Then, they coerced five workers from across the country who had never worked offshore to sign the new so-called agreement that, because of industrial laws loopholes, can apply to the rest of the workforce.<\/p>\n

 <\/p>\n

Called \u00e2\u20ac\u0098sham enterprise agreements\u00e2\u20ac\u2122, they\u00e2\u20ac\u2122re a tactic gaining in popularity among businesses in Australia. While the government has pledged to take action and courts have in some cases quashed them, sham enterprise agreements are still in many cases legal.<\/p>\n

 <\/p>\n

Seething from their employers\u00e2\u20ac\u2122 betrayal, Troy and his colleagues, members of the Australian Manufacturing Workers’ Union (AMWU), the Australian Workers’ Union (AWU) and the Electrical Trades Union (ETU) refused to sign the new contract.<\/p>\n

 <\/p>\n

\u00e2\u20ac\u015bHow could we possible justify this to our families \u00e2\u20ac\u201c signing a contract that would take us away from our wives and children for longer with drastically less pay?\u00e2\u20ac\u0165 Troy noted.<\/p>\n

\"esso<\/p>\n

From that day forward the workers would picket outside the gates of the company (pictured above) for weeks on end. Their numbers have fallen as the dispute continues \u00e2\u20ac\u201c from more than 100 people last year to 15 today.<\/p>\n

 <\/p>\n

\u00e2\u20ac\u015bIt\u00e2\u20ac\u2122s been really hard \u00e2\u20ac\u201c and that\u00e2\u20ac\u2122s purely from the length of the dispute. That\u00e2\u20ac\u2122s what the company wants us to do; to throw in the towel. But the 15 people we have left is an amazing feat after so long. These 15 people are committed to fighting for as long as it takes.\u00e2\u20ac\u0165<\/p>\n

 <\/p>\n

Since the workers\u00e2\u20ac\u2122 protest began, they\u00e2\u20ac\u2122ve maintained a picket line outside the site in Longford 24 hours a day, seven days a week. They\u00e2\u20ac\u2122ve persisted even in the face of court orders banning the inflatable \u00e2\u20ac\u0098Scabby the Rat\u00e2\u20ac\u2122 and private investigators intimidating them by photographing their activity on the picket lines.<\/p>\n

 <\/p>\n

Troy tells UNITElive that since their fight isn\u00e2\u20ac\u2122t a strike in the technical sense of the term \u00e2\u20ac\u201c the workers have lost their jobs \u00e2\u20ac\u201c resolving the dispute will likely require a change in the law.<\/p>\n

 <\/p>\n

Tax justice<\/strong><\/em><\/p>\n

While Troy and his union colleagues lobby the government in a campaign to change industrial laws so that sham agreements become illegal, they\u00e2\u20ac\u2122ve also launched a campaign to expose ExxonMobil\u00e2\u20ac\u2122s failure to pay any tax in Australia.<\/p>\n

 <\/p>\n

\u00e2\u20ac\u015bThrough our research we\u00e2\u20ac\u2122ve discovered that ExxonMobil has made in excess of $24bn from Australian resources since 2013 but have paid zero in corporate tax. They\u00e2\u20ac\u2122ll maintain these tax concessions until 2021.<\/p>\n

 <\/p>\n

\u00e2\u20ac\u015bOur view is — how come Exxon are saying they can\u00e2\u20ac\u2122t afford to pay good wages and conditions through their contractors yet they\u00e2\u20ac\u2122re making billions of dollars and not paying any tax?\u00e2\u20ac\u0165<\/p>\n

 <\/p>\n

For Troy, what\u00e2\u20ac\u2122s kept him going are his wife and his two children, aged nine and four.<\/p>\n

 <\/p>\n

\u00e2\u20ac\u015bThey\u00e2\u20ac\u2122ve suffered enormously from this dispute \u00e2\u20ac\u201c but ultimately even my four year old understands.\u00e2\u20ac\u0165<\/p>\n

Troy recounts the story of when he first told his kids about the dispute.<\/p>\n

\u00e2\u20ac\u015bI tried to be positive about it but I didn\u00e2\u20ac\u2122t know what to say, so I just said that Daddy\u00e2\u20ac\u2122s boss is being greedy and wants to take all our money. My four year old came in from the other room with his money box and emptied it on the table; he said, \u00e2\u20ac\u0098It\u00e2\u20ac\u2122s okay Daddy here\u00e2\u20ac\u2122s all the money we need.\u00e2\u20ac\u2122\u00e2\u20ac\u0165<\/p>\n

\u00e2\u20ac\u015bIf a four year old can understand, then the CEO of one of the world\u00e2\u20ac\u2122s largest oil companies ought to understand too the suffering they\u00e2\u20ac\u2122re inflicting on families.\u00e2\u20ac\u0165<\/p>\n

Unite support<\/strong><\/em><\/p>\n

In the last few months, the sacked workers have taken their fight globally. Most recently they\u00e2\u20ac\u2122ve taken the story of their David and Goliath battle to Europe. Last week, Troy attended a tax justice conference in Geneva and then travelled to the UK to meet with Unite leaders and oil reps in London and Aberdeen as well as the global union IndustriALL, which Unite is affiliated to.<\/p>\n

\u00e2\u20ac\u015bWe are fully behind the union members in the ESSO\/UGL dispute \u00e2\u20ac\u201c we are supporting them all the way,\u00e2\u20ac\u0165 said Unite assistant general secretary Tony Burke (pictured above with Troy Carter). \u00e2\u20ac\u015bIt was an honour for myself and our oil industry reps in the UK and especially in Aberdeen to meet Troy and hear the inspiring story of their fight. These Australian oil workers have been treated appallingly by ExxonMobil and its contractors \u00e2\u20ac\u201c their actions are totally unacceptable.<\/p>\n

\u00e2\u20ac\u015bA company of its size and worth \u00e2\u20ac\u201c ExxonMobil is after all the third largest company by value in the world<\/em> \u00e2\u20ac\u201c needs to treat its workers decently. It needs to resolve the dispute with the AMWU instead of inflicting hardship on their members and their families.\u00e2\u20ac\u0165<\/p>\n
