{"id":20753,"date":"2020-04-15T13:08:52","date_gmt":"2020-04-15T12:08:52","guid":{"rendered":"http:\/\/unitelive.org\/?p=20753"},"modified":"2020-04-15T14:09:54","modified_gmt":"2020-04-15T13:09:54","slug":"unite-win-for-wages-and-clarity","status":"publish","type":"post","link":"https:\/\/unitelive.test.igniteamt.com\/?p=20753","title":{"rendered":"Unite win for wages and clarity"},"content":{"rendered":"<div id=\"fb-root\"><\/div>\n<p>In the first legal test of test of the\u00c2\u00a0government\u00e2\u20ac\u2122s job retention scheme (JRS),\u00c2\u00a0Unite has secured clarification that\u00c2\u00a0the scheme can be used\u00c2\u00a0by companies in administration\u00c2\u00a0during the Covid-19 crisis.<\/p>\n<p>Unite is now\u00c2\u00a0calling on Carluccio\u00e2\u20ac\u2122s workers who were\u00c2\u00a0made jobless in March when the restaurant chain went into administration to respond to the administrator\u00e2\u20ac\u2122s offer or\u00c2\u00a0get in touch with their union\u00c2\u00a0so that they can access the scheme and establish some wage security.<\/p>\n<p>The union took action because it was concerned that those workers who have not yet responded to an offer by the administrators faced the prospect of being made redundant over the Easter bank holiday weekend.<\/p>\n<p>Insolvency laws mean that administrators normally\u00c2\u00a0have to\u00c2\u00a0dismiss workers within 14 days of their appointment in order to avoid\u00c2\u00a0liability for their employment and wages, but the court\u00e2\u20ac\u2122s new\u00c2\u00a0direction means that the administrators can give more time for employees to respond.<\/p>\n<p>This is the first litigation involving the JRS and provides the blueprint for administrators to make use of the scheme to protect jobs during the virus crisis.<\/p>\n<p>\u00e2\u20ac\u015bTime was running out for some of our members in Carluccio\u00e2\u20ac\u2122s. They faced the prospect of being dumped out of work this weekend,\u00e2\u20ac\u0165 said Unite\u00e2\u20ac\u2122s assistant general secretary for political and legal affairs, Howard Beckett.<\/p>\n<p>Beckett continued, \u00e2\u20ac\u015bIn taking this action, Unite has secured them some wage security. It is now essential that all those Carluccio&#8217;s workers who have either not received a letter or not responded to the letter from the administrator get in touch with their union, Unite, or the administrator immediately to ensure they are not dismissed and lose out on the opportunity that this court judgement has ensured.<\/p>\n<p>\u00e2\u20ac\u015bWe will not hesitate to go into court to ensure our members livelihoods are protected in these difficult times.<\/p>\n<p>\u00e2\u20ac\u015bThe new Job Retention Scheme was put together in record time and its interaction with other areas of law \u00e2\u20ac\u201c in this case insolvency law \u00e2\u20ac\u201c needed to be looked at by the High Court.\u00e2\u20ac\u0165<\/p>\n<p>He added, \u00e2\u20ac\u015bThis important decision ensures that no one is left behind in a hospitality sector reeling from the effects of the shutdown.\u00e2\u20ac\u0165<\/p>\n<p>Administrators were appointed to oversee the collapse of the restaurant chain on March 30, four days after the treasury had published details of its Covid JRS.
