{"id":9649,"date":"2016-08-31T11:30:57","date_gmt":"2016-08-31T10:30:57","guid":{"rendered":"http:\/\/unitelive.org\/?p=9649"},"modified":"2016-08-31T16:04:52","modified_gmt":"2016-08-31T15:04:52","slug":"taking-a-bite-out-of-apple","status":"publish","type":"post","link":"https:\/\/unitelive.test.igniteamt.com\/?p=9649","title":{"rendered":"Taking a bite out of Apple"},"content":{"rendered":"<div id=\"fb-root\"><\/div>\n<p>The European Commission (EC) has taken a bite out of Apple by ordering it to pay the Irish government up to \u00e2\u201a\u00ac13bn (\u00c2\u014111bn) in back taxes, after ruling the tech company\u00e2\u20ac\u2122s tax arrangements with the country were illegal.<\/p>\n<p>&nbsp;<\/p>\n<p>The ruling is a major blow to multi-national corporations who <a href=\"http:\/\/unitelive.org\/?s=Tax+avoidance\">avoid tax<\/a> on their incomes across Europe through the use of \u00e2\u20ac\u015bsweetheart\u00e2\u20ac\u0165 deals offered by individual EU states.<\/p>\n<p>&nbsp;<\/p>\n<p>The <a href=\"http:\/\/ec.europa.eu\/news\/2016\/08\/20160830_2_en.htm\">commission<\/a> said the deals between Ireland\u00e2\u20ac\u2122s tax authorities and Apple, which took place from 1991 and 2015, were the equivalent of illegal state aid and stated that Apple\u00e2\u20ac\u2122s \u00e2\u20ac\u015bhead office\u00e2\u20ac\u0165 in Ireland was a fa\u0102\u00a7ade that could not have generated the profits attributed to it.<\/p>\n<p>&nbsp;<\/p>\n<p>The arrangements, which were changed last year, allowed Apple to avoid tax throughout the EU single market because the company recorded almost of all its profits as having been made in Ireland. Apple\u00e2\u20ac\u2122s effective tax rate in Ireland in 2003 was 1 percent in 2003, dropping to 0.005 percent in 2014, the commission noted.<\/p>\n<p>&nbsp;<\/p>\n<p>EC competition commissioner, Margrethe Vestager said: \u00e2\u20ac\u015bMember states cannot give tax benefits to selected companies \u00e2\u20ac\u201c this is illegal under EU state aid rules. The commission\u00e2\u20ac\u2122s investigation concluded that Ireland granted illegal tax benefits to Apple, which enabled it to pay substantially less tax than other businesses over many years.\u00e2\u20ac\u0165<\/p>\n<p>&nbsp;<\/p>\n<p>The Irish government has said it will <a href=\"http:\/\/www.rte.ie\/news\/business\/2016\/0830\/812870-eu-apple-tax-decision-reaction\/\">appeal<\/a> against the ruling, which came after a three year EC investigation, because it will damage the country\u00e2\u20ac\u2122s standing as a low tax destination for foreign businesses. Previously Apple\u00e2\u20ac\u2122s chief executive Tim Cook <a href=\"http:\/\/www.independent.co.uk\/life-style\/gadgets-and-tech\/news\/apple-tim-cook-tax-avoidance-total-political-crap-a6781601.html\">described<\/a> the EC\u00e2\u20ac\u2122s investigation as \u00e2\u20ac\u015bpolitical crap\u00e2\u20ac\u0165 and vowed to appeal any attempt to make the company pay back taxes.<\/p>\n<p>&nbsp;<\/p>\n<p>Despite Apple\u00e2\u20ac\u2122s resistance it would have no problem paying \u00e2\u201a\u00ac13bn, which amounts to the annual cost of Ireland\u00e2\u20ac\u2122s health service budget, because the company has stockpiled more than $230bn in securities and cash. Campaigners in Ireland are demanding that the money be spent on a social housing drive.<\/p>\n<p>&nbsp;<\/p>\n<p>City University professor and tax campaigner Richard Murphy said the ruling would also benefit other EU states.<\/p>\n<p>&nbsp;<\/p>\n<p>He said, \u00e2\u20ac\u015bThis is a great day for the sovereignty of the EU\u00e2\u20ac\u2122s nations when it comes to tax. They will now be able to choose their own tax policies knowing another state should not be consciously undermining them when doing so.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bThis might be the beginning of the end for tax competition in Europe, or tax warfare as it is better described. Today might herald the creation of what Europe has always wanted, which is a level playing field on which all businesses compete.\u00e2\u20ac\u0165<\/p>\n<p>&nbsp;<\/p>\n<p>Unite assistant general secretary Steve Turner warned that the British government must be part of Europe\u00e2\u20ac\u2122s stand against tax avoidance regardless of its position within the EU.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bThe key is that in future we have a progressive taxation system where wealth and income are taxed fairly and large multinationals pay their fair share \u00e2\u20ac\u201c and are not able to use loopholes to scandalously avoid their taxes,\u00e2\u20ac\u0165 Turner said.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00e2\u20ac\u015bBillions are lost to our economy because of the practices of companies determined not to properly contribute to the public purse that provides the infrastructure and support that enable their businesses to thrive.
